Article 1

Scope of application and modification of the general terms and conditions of sale

These general terms of sale (hereinafter the "General Conditions") apply to the relationships between BN Nutrition SA (hereinafter "BN Nutrition SA") and any person placing an order on one of the websites of BN Nutrition SA (hereinafter: the "Customer" or "Customers").

BN Nutrition SA reserves the right to adapt or modify the General Terms and Conditions at any time, which will immediately apply to any new order. For each order, the Customer must confirm they have read and accept the General Terms and Conditions. These therefore apply to any order placed by the Customer (hereinafter referred to as the "Order").

The potential special conditions mentioned on the website(s) operated by BN Nutrition SA (hereinafter: the "Website" or "Websites") depending on the displayed products are an integral part of the General Conditions. In case of discrepancy between the special conditions and the General Conditions, the special conditions prevail.

Article 2

Products mentioned on the Internet sites and customer orders

The products visible on the Websites and the real-time stock status of the product displayed on the Website are purely indicative and do not constitute offers from BN Nutrition SA. In particular, the photos displayed on the Website are not contractual.

All information provided on www.bn-nutrition.ch (product descriptions, illustrations and photos, films, dimensions, weight, technical specifications, accessories and other data) are provided for informational purposes only and are not in any way a formal guarantee of these characteristics. BN Nutrition SA furthermore assumes no responsibility for the contents of external web pages and partner shops linked via the Internet.

Based on this non-contractual information, the Customer can place an order for the product or products displayed, exclusively by following the procedure provided by the Website and respecting the order terms outlined on the Website.

Any Order, once finalized according to the order process available on the Website, constitutes an offer from the Customer to purchase the product displayed on the Website, under the conditions indicated on the Website.

For each Order, the Customer must provide an email address to which all communications from BN Nutrition SA related to the Order will be sent. It is the Customer's responsibility to keep this address up-to-date and to read the emails sent by BN Nutrition SA. Any communication sent by BN Nutrition SA to the email address provided by the Customer will be considered as received by the Customer the day after it was sent. The risks of transmission and delivery are assumed by the Customer.

Article 3

Order validation - firm and non-cancellable orders

To place an order, the Customer must be of legal age (18 years or older) and must not be under guardianship or curatorship. The Customer guarantees that all information provided is accurate and is therefore accountable to BN Nutrition SA for any damage related to inaccurate information.

The order placed by the Customer in accordance with Article 2 above constitutes a firm and definitive offer to purchase the product indicated as available on the Website. Once definitively validated by the Customer, this order cannot be withdrawn until the Customer receives the acceptance or refusal decision from BN Nutrition SA.

BN Nutrition SA will be free to accept or refuse, without indicating the reasons, any order from a Customer. BN Nutrition SA will communicate its decision of acceptance through an email sent to the address provided by the Customer in their Order (order confirmation).

Article 4

Price

BN Nutrition SA reserves the right to change its prices at any time, but commits to applying the rates displayed at the time of the Order.

The prices shown are in Swiss francs and include all taxes. The customer must also pay delivery costs, which are indicated on the order form.

The prices indicated are only valid in the territories of Switzerland and the Principality of Liechtenstein.

Article 5

Advance payment and security

The customer's offer to order a product from BN Nutrition SA implies an advance payment of the order amount and fees. The following are accepted:

  • Visa
  • Mastercard
  • Paypal
  • Twint
  • Invoice 

The advance payment is made on the secure banking or postal servers of BN Nutrition SA's partners, as mentioned above. This implies that no banking or postal information concerning the client is transmitted via the sites of BN Nutrition SA. Therefore, payment by credit or debit card is completely secure.

The order will be recorded and validated upon acceptance of the payment by the payment system chosen by the Customer. His Order will be validated and his card will be charged automatically at the time of the Order registration.

The customer must fill out the registration form that is provided on the Internet Site, before being able to validate an order. The details of the customer's credit card or Postcard are encrypted using an SSL (Secure Socket Layer) protocol and never circulate in clear form on the network. The payment of the advance is made directly to the bank or the Post. The card number is not sent to BN Nutrition SA.

The risk of a malfunction in the payment system is borne by the Client.

Article 6

Delivery terms and delivery times

The products are delivered to the delivery address indicated by the Customer in the Order. The risks associated with sending the goods to the Customer (risk of loss, destruction, incorrect delivery address, etc.) are borne by the Customer as soon as BN Nutrition SA hands over the goods to the carrier designated by BN Nutrition SA. In case of an error in the wording of the recipient's details, BN Nutrition SA cannot be held responsible for the impossibility in which it might find itself to deliver the product.

The costs associated with the return of an unclaimed package and any possible reshipment are the responsibility of the customer. Before any reshipment, BNNutrition SA may ask the customer to first pay the related costs.

In the case of an unclaimed package, BN Nutrition SA cannot be held responsible, including in the case where the Post Office does not leave a notice of passage. The return costs and the risks inherent to this transport are the responsibility of the Customer.

In the event of the return of the parcel to the premises of BN Nutrition SA due to an inability to deliver it (exceeded postal deadlines, incorrect recipient address, etc.), the customer is automatically notified by an email sent to the email address indicated in the order. If there is no response from the customer within a period of 3 months from the sending of the email, BN Nutrition SA reserves the right to cancel the order. In such a case, BN Nutrition SA is released from its obligation to deliver the goods and the advance paid by the customer to BN Nutrition SA at the time of the order will be retained by BN Nutrition SA as conventional damages, this being for the balance of all accounts and all claims for the considered order.

The preparation and shipping costs are always clearly indicated during the order. Delivery is made in packages by the postal services or by one of the freight forwarders chosen by BN Nutrition SA.

Any available item is generally shipped within 2 business days (weekends and holidays are excluded from the deadline). The indicated times are average times and correspond to the processing, preparation and shipping time of any order (warehouse departure).

In the event that BN Nutrition SA is unable to deliver the ordered goods within 30 days (warehouse dispatch date), the customer can cancel the order by an email or a letter addressed to BN SA's customer service, mentioning the reference of the order. This cancellation will only be taken into account if it reaches BN Nutrition.Its 24 hours before the ordered goods are handed over to the carrier designated by BN Nutrition SA. Otherwise, the order cannot be canceled. The cancellation must also reach BN SA before the deadline within a period of 40 days after the order.

In the event of a valid cancellation, the advance payment made by the Customer at the time of the Order will be refunded to them in full and final settlement of all accounts and claims. The Customer may in no way claim additional damages from BN Nutrition SA, their claims being limited exclusively to the full refund of the advance payment.

BN Nutrition SA also has the right to cancel an order even if it has been accepted, without having to provide reasons to the Customer. In such a case, the Customer's claims against BN Nutrition SA are limited to the refund of the advance payment, excluding any damages.

Upon receipt of the Order by the Customer, the latter must immediately proceed with the inspection of the delivered goods.

To identify visible defects (packaging defects, delivered product not matching the ordered product, possible missing products, etc...), the Customer must check the conformity of the delivered goods. 

Article 7

Responsibilities

BN Nutrition SA is only liable for direct damages that the customer proves are caused by a serious fault of the company or a mandated third party. Any liability for mild fault or simple negligence is excluded.

In the event of liability for BN Nutrition SA, its liability is limited to the price of the product delivered or the service provided. Any broader liability of BN Nutrition SA, its assistants or third parties commissioned by it for damages of any kind is excluded. In particular, the customer has no claim for compensation for damages not affecting the product itself.

The choice and purchase of a product or service is solely the responsibility of the Customer. The total or partial inability to use the products, particularly due to product or service incompatibility, cannot give rise to any compensation, reimbursement, or challenge to the responsibility of BN Nutrition SA.

In all cases, any claim for damages will be limited to the maximum amount corresponding to the price paid by the Customer at the time of his Order.

The regulations specified by the previous paragraph also apply to the legal representatives, executives and execution assistants of BN Nutrition SA.

Important notice: please consult your doctor to check that you are not subject to a known food intolerance. The same applies for any possible interactions with products that you would consume at the same time.

Article 8

Return and refund procedure, warranty and warranty limitations

The warranty for hidden defects is limited to a maximum of one month (from the date of departure from our warehouses). Beyond this period, BN Nutrition SA will not accept any claims. The existence of a longer manufacturer's warranty is reserved (see Chapter 9 below).

No returned merchandise will be accepted if it is not in its original packaging or if the return of the goods was not preceded by a return request from the customer service of BN Nutrition SA.

Upon receipt of the return, the Customer has a period of 7 days to return the defective product to BN Nutrition SA. After this period, any return will be refused. The return must be made in a registered parcel, with the Customer bearing the risks and costs associated with this return.

For defective products returned by the Customer in accordance with the procedure provided in this chapter, the obligations of BN Nutrition SA are limited, at the sole discretion of BN Nutrition SA:

- either to have the product repaired at their own expense within a reasonable period of time ;
- either to proceed with the replacement of the product by standard exchange or by providing an equivalent product ;
- either to reimburse the client for the amount paid at the time of the order. A repair under warranty does not extend the duration of the warranty.

Article 9

Client's Obligations

The Client undertakes to use the purchased product according to the provided instructions and recommendations. The Client must keep the invoice and the original packaging related to the purchased product. 

Article 10

Data protection

By registering on the site www.bn-nutrition.ch, the Client expressly consents to receiving advertising or other information from www.bn-nutrition.ch. The customer may unsubscribe at any time, easily and free of charge, by following the instructions in the respective message or by contacting the BN Nutrition Customer Service.It's not clear what you want me to translate. www.bn-nutrition.ch Transmits personal data to third parties only to the extent necessary for the proper execution of the Order.

BN Nutrition SA has the right to remove a registered Client from its computer files at any time, i.e., to terminate their registration, with immediate effect, without having to justify its decision, without notifying the Client and without the registered client in question being able to make any claim against the company. This is particularly applicable to registered clients who violate the present general conditions.

Exclusive registered customers are not allowed to re-register as registered customers on the BN Nutrition SA websites, whether under their own name or another, without the prior agreement of BN Nutrition SA.

Article 12

Applicable law and jurisdiction

The present contract, as well as the sales organized by BN Nutrition SA, are governed by Swiss law. In case of dispute, the legal forum is Neuchâtel - Neuchâtel exclusively, with recourse being reserved.

Article 13

Safeguard clause

In the event that certain articles or paragraphs were without legal value, or if the contract contained one or more gaps, it remains applicable as a whole with the exception of the incriminated articles or clauses.

Original text

The general terms and conditions of BN Nutrition SA are written in French and German. In case of contradiction, the French version prevails.
